By accessing or using BillableDay ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Beta Program Disclaimer

The Service is provided as a beta release. This means:

• Features may change, be added, or removed without notice
• You may experience bugs, errors, or service interruptions
• Data loss may occur (though we take precautions to prevent this)
• Premium features are currently available at no cost during beta
• Pricing and feature availability will be finalized before general release

By using the beta, you acknowledge these limitations and agree to provide feedback to help improve the Service.

3. Description of Service

BillableDay is a time tracking and task management tool designed for consultants and freelancers. The Service allows you to:

• Track time spent on tasks and projects
• Manage clients and associated hourly rates
• View calculated earnings based on tracked time
• Generate reports for your records

4. Account Registration

To use BillableDay, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

You must be at least 16 years old to create an account.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit malware or other harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for fraudulent purposes
• Automate access without our written permission

6. Your Data

You retain ownership of all data you enter into BillableDay. By using the Service, you grant us a limited license to:

• Store and process your data to provide the Service
• Create backups for disaster recovery
• Generate anonymized, aggregated statistics

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we'll try to notify you in advance)
• Emergency maintenance or security updates
• Factors beyond our control (internet outages, third-party services)

We are not liable for any losses resulting from service unavailability.

8. Account Termination

By You: You may delete your account at any time through your profile settings. Your data will be permanently deleted within 30 days.

By Us: We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the Service or our support resources

We will provide reasonable notice before termination unless immediate action is required for security reasons.

9. Intellectual Property

The Service, including its design, code, and content, is owned by BillableDay and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the Service
• Reverse engineer or decompile the software
• Use our branding without permission
• Create derivative works based on the Service

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim (or $100 if you used only free features)

This limitation applies to claims arising from use of the Service, including data loss, business interruption, or inaccurate calculations.

11. Indemnification

You agree to indemnify and hold harmless BillableDay and its team from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. When we do:

• We will update the "Last updated" date at the top
• Material changes will be communicated via email or in-app notification
• Continued use after changes constitutes acceptance

If you disagree with changes, you may delete your account before they take effect.

13. Governing Law

These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles. Any disputes shall be resolved in the courts of England and Wales.
